Government Service Contracts

When a service contract expires and a follow-up contract is awarded for the same service in the same location, the successor contractor or its subcontractors often hire the majority of the predecessor`s employees. In some cases, however, a successor contractor or its subcontractors hire a new workforce, replacing the predecessor`s employees. The DOL fact sheet #67A states: “The Confederation`s procurement interests in terms of cost-effectiveness and efficiency are served if the successor contractor hires the predecessor`s employees. A transferred workforce reduces disruption in service delivery during the transition period between contractors and provides the federal government with the benefits of an experienced and trained workforce that is familiar with federal government personnel, facilities and requirements. Therefore, it is the policy of the federal government that service contracts and invitations to such contracts contain a clause that requires the contractor and its subcontractors, under a contract following a contract, to provide the same or similar services in the same location to employees (with the exception of managers and supervisors) who are employed under the previous contract and whose employment relationship is with the following the Award of the successor contract, a right of first refusal of employment under the contract in the positions for which they are qualified. There are no job offers in the contract until such a right of first refusal has been granted. Nothing in this order shall be construed as permitting any contractor or subcontractor to fail to comply with any provision of any other executive order or law of the United States. 37,500 Scope of the paragraph. This paragraph defines the responsibilities related to the implementation of the Federal Procurement Policy Office policy letter (PFO93-1, Oversight of the Management of Service Contracts).
