Afge Legal Assistance

The General Counsel`s Office (GCO) of the American Federation of Government Employees (AFGE) provides AFGE, its officers, members, employees and affiliates with a wide range of legal assistance. The legal rights lawyer`s position focuses on affirmative administrative disputes aimed at protecting the employment and union rights of workers in the collective bargaining unit. In dealing with cases likely to obtain the winning party`s attorney`s fees, the holder is responsible for: keeping simultaneous time records using a system approved by GCO; carry out legal work in a manner consistent with ethical and other requirements for the allocation of lawyers` fees at market prices; Collect market interest charges for deposit in the AFGE Legal Representation Fund to the extent possible; and to assist GCO in maintaining accurate records of fees deposited in the AFGE Legal Representation Fund. Interested candidates must submit their CV to jobs@afge.org. The incumbent reports to the AfGE Advocate General and the Deputy Advocate General for Litigation and works under daily legal supervision. The incumbent usually receives assignments from the Deputy Advocate General. Functions are subject to generally applicable legal policies and procedures established by the General Counsel and/or Deputy General Counsel, as well as policies and procedures established by the AFGE National Executive Committee. The incumbent will systematically advise the Advocate General and the Deputy Advocate(s) General on the status of duties, workload and matters affecting AFGE and the GCO. The incumbent is responsible for reviewing assigned issues in a timely manner and making recommendations to the Advocate General and Deputy Advocate General as to whether GCO should provide representation. Under no circumstances may the licensee offer or refuse a performance. Tasks may include, inter alia, the independent and competent handling of all aspects of complaints and arbitration procedures and appropriate procedures for unfair labour practices; oppositions to the arbitral award; fee-generating arbitration proceedings, MSPB or EEO; the interpretation of the Agency`s rules and regulations; as well as the provision of other legal advice, training or support, as appropriate. This work often includes, but is not limited to, the discovery or submission of requests for information, the evaluation and organization of evidence and/or exhibits, the preparation of witnesses and the search, preparation and submission of legal claims, memoranda and/or pleadings, and the handling of the case of the union or the case of one or more individual members of the collective bargaining unit.

Responsibilities may also include providing legal advice and guidance to AFGE, its officers, members and collaborators, conducting legal training or clinics, and providing other necessary forms of support. This work works in a professional environment to determine the objectives of the Federation and the Department. The incumbent will regularly use standard office equipment such as computers, fax machines, scanners and telephones. Long hours are required regularly. The employee must regularly lift and/or move items larger than 10 pounds. The incumbent of the position of Legal Rights Lawyer is primarily responsible for representing the First President in affirmative administrative disputes that may result in the recovery of payment arrears, and for recovering the winning party`s attorney`s fees for the deposit in the AFGE Legal Representation Fund. The incumbent is regularly encouraged to exercise independent judgment and discretion in the assessment and litigation of assigned matters. The holder must hold a JD degree from a validly accredited law school. The holder must also be a respected member of all the orders of the bar to which he is admitted.

At all levels, the incumbent must have the necessary judgment and ability to meet and deal appropriately with government representatives of various levels of authority, Congress staff, AFGE leadership, members and staff, including members of the AFGE National Executive Board, and officials of other unions. This position is exempt from the RSA and is located at the OCG at AFGE headquarters in Washington, DC. Frequent travel is required and must be approved in advance by the Advocate General and/or the Deputy Advocate General for litigation or their officers.
